(c) Actions taken by the government pursuant to this clause shall in no way be considered a
termination for default. Upon payment of all negotiated amounts, all responsibilities and obligations
of the parties are discharged.

5252.236-9300 LIMITATIONS ON AUTHORITY OF A-E (JUN 1994)
Unless specific exceptions are established by a written instruction issued by the Contracting Officer,
the A-E:
(a) Shall not authorize any deviation from the construction contract documents or approve any
substitute materials or equipment.
(b) Shall not exceed limitations on the Government's authority as set forth in construction contract
documents.
(c) Shall not undertake any of the responsibilities of the contractor, subcontractors, construction
contractor's Superintendent or Contractor Quality Control Representative.
(d) Shall not expedite or accelerate the work of construction contractor and subcontractors.
(e) Shall not advise on or issue directions relative to any aspect of the means, methods, techniques,
sequences or procedures of construction unless such is specifically called for in construction contract
documents.
(f) Shall not authorize or advise users to occupy projects in whole or in part, unless agreed to by the
Contracting Officer.

5252.236-9302 A-E CONTRACTS FOR CONSULTATION AND ADVICE (JUN 1994)
In addition to the services required by any other contract provisions, the contractor shall provide
work-days of general engineering services and consultation at the construction site or at such other
locations as the Government may desire, when and as required by the Contracting Officer during the
course of construction.

SEARCH
(a) The Contractor will maintain an accurate record of, and will report to the Contracting Officer in the
manner and on the forms prescribed by the Contracting Officer, all accidents resulting in death,
traumatic injury, occupational disease, and damage to property, materials, supplies and equipment
incident to work performed under this contract.
(b) Compliance with the provisions of this article by subcontractors will be the responsibility of the
Contractor.
